    December 2008

    Dear friends,

We wanted to provide you the most recent update on our ongoing focus and work to ensure the safety of all the products we sell. As you may have been reading in the media, there has been a great deal of discussion regarding the implementation of the Consumer Product Safety Improvement Act passed by Congress in August of 2008. While there has been confusion over the implementation of the law, we want to be clear on our position with regards to the new standards.
    1. We strongly support and believe in the aims of the legislation to ensure that we have safe products for our children.
    2. We will continue to be guided by our “child first” policy and the simple, common sense approach of “doing the right thing” as we implement the standards of the law.
    3. We appreciate your patience and support as we continue to adjust inventory, source new vendors and work to make sure we are meeting the new standards.
It has been a very busy time since August as we have worked to meet the requirements and the spirit of the new law. We wanted to update you briefly on a few of the actions we have taken since our last update.
    • We have established a third party testing relationship with a worldwide, certified testing company that can conduct product tests across the world on both lead and phthalate concerns.
    • We have tested our direct import items and when necessary have removed these items from inventory and sale if it has not met our stringent standards.
    • We have worked with all vendors both domestic and overseas to ensure they have a thorough understanding of the new U.S. product safety requirements. This includes personnel attending product safety training classes.
    • We have developed an active and vibrant system for the tracking of test results and certificates of compliance from vendors.
    • We have upgraded our internal standards to ensure that all new products meet and exceed the standards established by the legislation.
    • We have worked with all vendors to inform them of our requirements under the CPSIA legislation including certification requirements and tracking label requirements that will become effective in August 2009.
    • We have reviewed over 2,000 individual items to determine if cautionary statements are appropriate or required. Based on this analysis, we have added cautionary statements both in catalogs and on the internet where appropriate.
    • Following a final ruling on cautionary statements, we once again reviewed all cautionary statements to ensure compliance with the final ruling of the Consumer Product Safety Commission on cautionary statements.
    • We have worked to meet and exceed the standards of major US retail chains with whom we do business providing them the required compliance information.
    • We have removed from inventory availability products produced before February 10, 2009 that may not be in compliance with the CPSIA standards.
    • We have invested literally thousands of person hours and over $100,000 USD in testing and compliance fees since August to ensure that we are meeting the new standards.
We are proud of the work we have done to quickly meet the new standards and the spirit of the new law. We believe in providing you safe product and in allowing you to enjoy our products without concern. We hope that by continuing to update you on our work in this area you will see our commitment to product safety. Again, if you have any questions or concerns or identify an issue we should be aware of, please let us know at 1-800-314-8794 or csr@shindigz.com.

Our thanks for your support and we look forward to continuing to serve you.

    Sincerely,

    ShindigZ
